GENERAL TERMS OF SALE E-COMMERCE

The offer and sale of products on the website is governed by the following General Terms of Sale online.

1. COMPLETION OF THE CONTRACT

1.1 The order sent by the user via the on-line form constitutes an offer addressed to Martylò S.r.l. aimed at completing a sales contract, at the conditions indicated therein as well as in compliance with these General Terms of Sale which the customer undertakes to fulfil by submitting the order form. Consequently, by electronically submitting the order form, the customer confirms knowledge and acceptance of the General Terms of Sale as well as receipt of the further information, again available on the website www.martylo.it and cited via links. Provision of the VAT number or tax code by the Customer is mandatory when filling in the personal data.

1.2 After submitting the order in electronic format, the customer will receive a confirmation e-mail containing the order details (Order Confirmation). Execution of the orders is conditional to full payment of the price by the customer. Consequently, non-payment of the price will result in automatic termination of the contract.

2. PRODUCT DETAILS AND PRICES

2.1 The product details are those presented on the website and described on each product sheet. However, the images and colours of the products offered for sale online may not correspond to the actual products as a result of any improvements made or due to the effect of the specific Internet browser and monitor used.

2.2 Product prices may be subject to updates. Prices are inclusive of VAT at 22%.

3. SHIPPING/DELIVERY COSTS

3.1. Shipping costs throughout the European community are free.

Costs for shipments to all other countries and continents are free as far as the Italian border.

3.2 In the event of visible damage to the package, the customer is required to check the product supplied, at the time of delivery in the presence of the courier, and to accept delivery “with reservation”.

4. DELIVERY TIMES and METHODS

4.1 The goods will be shipped by TNT/FEDEX express courier

4.2 Delivery in Italy is scheduled for 3 working days from order confirmation.

4.3 Delivery of goods to other parts of the world is expected to take 3/7 working days (depending on the geographical area).

5. METHODS OF PAYMENT

5.1 Payment of the price of the products and relative shipping costs can be made via PayPal or Nexi.

6. RIGHT TO CANCEL/CHANGE THE ORDINE

6.1 To cancel or change the order send an email to customercare@martylo.it and specify the reference number and any other information (company name, date of order) able to uniquely identify the order in question. You will receive a confirmation of cancellation/modification of your order and information about the refund of any amounts already paid.

7. RIGHT OF WITHDRAWAL

7.1 In accordance with the provisions of the Consumer Code, the customer may exercise the right of withdrawal from the sales contract as follows: a) The request must be sent to Martylò Srl within 14 (fourteen) working days of receipt of the products; b) Martylò Srl will make a refund within 30 days of receipt of the returned material which must be returned, with costs to be borne by the Customer, to the following address: MARTYLO’ SRL, Via G.Di Vittorio, 16/18 50053 EMPOLI (FI) Italy. 8.RETURN AND REFUND

8.1 For product replacement please see the refund policy/online refund criterion at link https://www.martylo.it/en/politica-rimborsi which is to be considered an integral part of these General Terms.

9. DATA PROTECTION

9.1 The data controller for the processing of data collected via this website is MARTYLO’ SRL, registered in the Florence Companies Register, Economic and Administrative Index FI-547937, tax ID and VAT no. IT05450800486, with registered office in Via G di Vittorio, 16/18/20 – 50053 Empoli (Florence) Italy, certified e-mail address martylo@pec.it.
It decides on the purposes and methods of processing, as well as on the security procedures to be applied to ensure data confidentiality, integrity and availability. Some data must be compulsorily provided to Martylò S.r.l. to conclude the contract. Any refusal to communicate certain data marked as mandatory will make it impossible to provide the service for which it has been requested.

9.2 Personal data will be treated with the utmost confidentiality. E-mail addresses will be used exclusively for sending the newsletter (customer information, special offers). In any case, it is always possible to request and obtain the deletion of personal data from the database by sending a request to the following certified e-mail address. martylo@pec.it

10. APPLICABLE LAW AND SETTLEMENT OF DISPUTES

10.1 The General Terms of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005 on the consumer code, according to which, an online sales contract is understood to be a remote contract, i.e. the legal transaction concerning movable goods and/or services stipulated between a professional, in this case MARTYLO’ S.r.l., via the online service www.martylo.it, and a consumer, within the framework of a remote SALE SYSTEM organized by the professional, who, for such contract, uses exclusively the remote communication technology known as internet, with specific reference to the regulations on remote contracts and to Legislative decree no. 70 of 9 April 2003 on certain aspects concerning electronic commerce.
The term “professional” means any natural or legal person acting in the exercise of his trade or profession, or intermediary thereof.
A consumer is a natural person of legal age who is acting for purposes unrelated to any business or professional activity.

10.2 For any dispute arising from these general terms of sale, the jurisdiction of the Court of Florence is agreed, pursuant to current legislation.
